Bridge 247 Replacement - York County

Project: York County Bridge 247 Replacement

Address:  Bridge No. 247 over Yellow Breeches Creek in Monaghan Township, York County and in Upper Allen Township, Cumberland County. The bridge is located on North Grantham Road and Mill Road.

Project Description: At the May 5, 2022 Board of Commissioners' meeting, a representative of Herbert, Rowland & Grubic, Inc. (HRG) shared plans to replace York County Bridge 247.  Here are the exhibits: Bridge Improvement Plan Exhibits

Legacy Park-Allendale Realignment

Legacy Park is a new home community located within Mechanicsburg Borough.  The development consists of various townhomes, single-family dwellings, multi-family apartments, and a commercial area.  As part of Phase 4, site improvements to a portion of Allendale Road within the township and lot add-ons are proposed for abutting property owners within the Township.

Transfer of a Liquor License - Public Hearing on November 16, 2022 at 6:30 P.M.

Notice is hereby given that the Board of Commissioners of Upper Allen Township, Cumberland County, Pennsylvania, will hold a Public Hear­ing on November 16, 2022 at 6:30 P.M., at the Upper Allen Township Municipal Building, 100 Gettysburg Pike, Mechanicsburg, Cumberland County, Pennsylvania 17055.

The purpose of said Public Hearing is to hear testimony and discuss the following:

APPROVING THE INTERMUNICIPAL TRANSFER OF RESTAURANT LIQUOR LICENSE R13939, CURRENTLY OWNED BY FOX FOODS, INC., d/b/a CJs AMERICAN PUB & GRILL, LOCATED AT 487 E. KING STREET, SHIPPENSBURG TOWNSHIP, CUMBERLAND COUNTY, PENNSYLVANIA  17257, TO BD&D EVENTS, LLC, d/b/a THE WILLOWS AT ASHCOMBE MANSION (“ASHCOMBE MANSION”), LOCATED AT 1100 GRANTHAM ROAD, MECHANICSBURG, CUMBERLAND COUNTY, PENNSYLVANIA 17055, AS REQUIRED BY THE PENNSYLVANIA LIQUOR CONTROL BOARD.

 

The regularly scheduled Board of Commissioners meeting for Wednesday, November 16, 2022 at 6:30 P.M., will commence after the close of the public hearing.  The Board of Commissioners, at such time as the regularly scheduled meeting begins at the Upper Allen Township Municipal Building, shall consider for enactment and, if approved by formal action, adopt and enact the proposed resolution.

 

The Resolution is as follows:

A RESOLUTION OF THE TOWNSHIP OF UPPER ALLEN, COUNTY OF CUMBERLAND, COMMONWEALTH OF PENNSYLVANIA, APPROVING THE INTERMUNICIPAL TRANSFER OF A RESTAURANT LIQUOR LICENSE OF A RESTAURANT LIQUOR LICENSE R13939, CURRENTLY OWNED BY FOX FOODS, INC., d/b/a CJs AMERICAN PUB & GRILL, LOCATED AT 487 E. KING STREET, SHIPPENSBURG TOWNSHIP, CUMBERLAND COUNTY, PENNSYLVANIA  17257, TO BD&D EVENTS, LLC, d/b/a THE WILLOWS AT ASHCOMBE MANSION (“ASHCOMBE MANSION”), LOCATED AT 1100 GRANTHAM ROAD, MECHANICSBURG, CUMBERLAND COUNTY, PENNSYLVANIA 17055, AS REQUIRED BY THE PENNSYLVANIA LIQUOR CONTROL BOARD INTO THE TOWNSHIP OF UPPER ALLEN.

 

            WHEREAS, the Pennsylvania Liquor Control Board ("PLCB") requires that the governing body of the receiving municipality pass legislation approving an intermunicipal transfer of a liquor license, and

           

WHEREAS, BD&D Events, d/b/a The Willows at Ashcombe Mansion (“Ashcombe Mansion”) wishes to purchase Restaurant Liquor License No. R13939 currently owned by Fox Foods, Inc. and located in Shippensburg Township and move it into the Upper Allen Township to be used by Ashcombe Mansion located at 1100 Grantham Road, Mechanicsburg, PA 17055. Ashcombe Mansion has added a commercial kitchen and, in addition to operating as a special event venue, will also have dining options.  As part of its operations, Ashcombe Mansion wishes to sell alcohol (beer, wine and spirits) for on-premises consumption and to go as permitted under PLCB regulations; and

WHEREAS, Act 141 of 2000 (the "Act") authorizes the Pennsylvania Liquor Control Board to approve, in certain instances, the transfer of a Restaurant Liquor License across municipal boundaries within the same county regardless of the quota limitations provided for in Section 461 of the Liquor Code if, as in Upper Allen Township, sales of liquor and malt or brewed beverages are legal within the municipality receiving the license; and

WHEREAS, the Act requires the applicant to obtain from the receiving municipality a resolution approving the inter-municipal transfer of the Liquor License prior to an applicant's submission of an application to the Pennsylvania Liquor Control Board; and

WHEREAS, the Liquor Code stipulates that, prior to adoption of a resolution by the receiving municipality, at least one hearing be held for the purposes of permitting individuals residing within the municipality to make comments and recommendations regarding applicant's intent to transfer a Liquor License into the receiving municipality, in this case, Upper Allen Township; and

WHEREAS, an Application for transfer filed under the Act must contain a copy of the Resolution adopted by the municipality approving the transfer of the Liquor License into the municipality.

NOW, THEREFORE, BE IT ORDAINED BY UPPER ALLEN TOWNSHIP that BD&D Events, d/b/a The Willows at Ashcombe Mansion has requested the approval from Upper Allen Township for the proposed transfer of the Pennsylvania Restaurant Liquor License No. R13939 which is currently owned by Fox Foods, Inc. and located in Shippensburg Township, into Upper Allen Township to be used at BD&D Events, d/b/a The Willows at Ashcombe Mansion, located at 1100 Grantham Road, Mechanicsburg, Upper Allen Township, Cumberland County, Pennsylvania 17055. It is understood that said transfer must be approved at a later date by the Pennsylvania Liquor Control Board; and be it further

ORDAINED that Upper Allen Township has held on the 16th day of November 2022, a properly advertised public hearing pursuant to the notice provisions of Section 102 of the Liquor Code to receive comments on the proposed Liquor License transfer; and be it further

ORDAINED that Upper Allen Township approves, by adoption of this Ordinance, the proposed inter-municipal transfer of Restaurant Liquor License R13939 into Upper Allen Township for use by BD&D Events, d/b/a The Willows at Ashcombe Mansion, located at 1100 Grantham Road, Mechanicsburg, Upper Allen Township, Cumberland County, Pennsylvania 17055; and be it further

 

ORDAINED that the transfers, designations, and assignment of the License hereunder is subject to the approval by the Pennsylvania Liquor Control Board.
